all content on this website, including but not limited to digital art, designs, and graphics is the sole property of Fern and Magic and is protected by copyright laws any unauthorized use such as copying, tracing, distribution or reproduction of any content is strictly prohibited and will result in legal action.
ALL designs are hand drawn and created on a 12x12 canvas at 300 dpi (unless stated otherwise)
All rights of this website and everything on it is owned and reserved by Fern and Magic upon purchasing no rights to these products are transferred to the customer and will remain with FAM
Please tag us in your creations with FAMs designs to give credit to the artist! We love seeing our artwork come to life
I as the artist hold the right to refund and or refuse any commission pieces (creative customs) for any reason with or without notice.
Permission to use is ONLY granted when purchasing directly from Fern and Magic’s website or FAMS VIP group with the proper licensing that’s needed.
LICENSING - if your shop has 2+ employees or you sell DTF, Stickers, in house fabric you need to buy a commercial license. You MUST purchase one for each design you buy and the license AND design must be purchased at the same time in order to be valid.
PROHIBITED
🌿 NO POD - I do not allow my artwork to be used or prints by POD companies this is including but not limited to zazzle,spoonflower, Amazon, etc doing so is in breach of our terms and service and you will be removed from any and all social medias as well as banned and removed from any design drives you may have in your possession without a refund or notice.
🌿 NO COPYING OR TRACING - you were not permitted to copy trace or replicate any of our products
🌿NO STEALING - any form of theft or unauthorized use of our digital products is strictly prohibited. This is including, but not limited to file sharing in dump groups or sharing my artwork with your friends,family or other small shops.
doing so is illegal and we reserve the right to take legal action as we see fit as well as remove you from Fern and Magic’s VIP group, banned, blacklisted and listed in beware shops. We do not take this lightly.
🌿NO ALTERATIONS - you may not alter, tamper with, change or modify my art in anyway including but not limited to color changing/editing, etc that infringes on our copyright.
🌿 NO SHARING designs without a watermark and do not attempt to remove my watermark
🌿NO SELLING - do not attempt to sell any of my digital products
Customers are also prohibited from sharing or distributing without properly watermarking to not only protect their shop but to also protect my art work
REFUNDS & RETURNS
I do NOT offer refunds OR returns since my products are digital I have no way I knowing if your still in possession of my artwork. Please make sure you double check designs and colorways in your cart before check out.
